On February 6, 2019, at approximately 6:30 p.m. [redacted] was standing in front of [redacted] in the Bronx. He was approached by PO Reynaldo Peña off the 44th Precinct, who was in a marked police van with PO Maximo Gomez, Sgt. Kevin Grayson, and PO Corey Graves, all of the 44th Precinct. When [redacted] first saw PO Peña, he ran, and PO Peña and Sgt. Grayson pursued him (Allegation A- Stop- [redacted] Allegation B- Stop- [redacted]). After a brief foot pursuit, [redacted] was taken to the ground at East 158th Street and Park Avenue (Allegation C- Force- [redacted]). After handcuffing [redacted] PO Peña allegedly placed his knee on the side of [redacted] neck, and restricted his breathing (Allegation D- Force- [redacted] Allegation E- Force- [redacted]). Just before he was placed in a Department vehicle, PO Peña allegedly pulled his pants down and strip-searched him (Allegation F- Abuse of Authority- [redacted]).
PO Peña waited in the police van with [redacted] and allegedly called [redacted] "retarded" (Allegation G- Offensive Language- [redacted]). PO Peña said to [redacted] "I don't want your fucking money" (Allegation H- Discourtesy- [redacted]).
At the 44th Precinct stationhouse, PO Gomez told [redacted] to "shut the fuck up" (Allegation I- Discourtesy- [redacted]). At the stationhouse, Sgt. Grayson authorized PO Peña to strip-search [redacted] (Allegation J- Abuse of Authority- [redacted]). During the strip search in the stationhouse, PO Peña, PO Gomez, and PO Graves allegedly called [redacted] "little dick," and allegedly repeated it when they lodged him in the holding cells (Allegation K- Abuse of Authority- [redacted] Allegation L- Abuse of Authority- [redacted] Allegation M- Abuse of Authority- [redacted]).
