Summary

On May 9, 2019, at approximately 1:10 p.m., [redacted] was pulled over at the intersection of Flatbush Avenue and Tilden Avenue in Brooklyn by PO Paul Casale and PO Brian McCarthy of the 70th Precinct for a broken taillight and failing to signal. After asking for his identification, PO Casale allegedly asked [redacted] if there was anything in his car that he and PO McCarthy should be aware of, which [redacted] denied (Allegation A: Abuse of Authority; [redacted] PO Casale then informed [redacted] that he smelled marijuana and directed him to step out of the car, which [redacted] refused to do. After a back and forth in which [redacted] refused to exit his vehicle, PO Casale allegedly opened the car door, pulled [redacted] out, and handcuffed him (Allegation B: Force; [redacted] was then transported to the 70th Precinct stationhouse by PO Peter Borisenko of the 90th Precinct.
