On May 6, 2019, in front of Bronx Terminal Market across from 651 River Avenue in the Bronx, [redacted] parked his vehicle to pick up his sister, [redacted] While helping [redacted] into the back of the vehicle, [redacted] was noticed by field training Police Officer Roosvelt Monestime and his trainee, Police Officer Benjamin Hinderman, both of the 44th Precinct. PO Monestime suspected [redacted] of operating an illegal taxi, because in his police experience, normal drivers do not walk up to the people they are supposed to pick up from a location and also have them sit in the back of the vehicle. PO Monestime approached [redacted] and asked for his license and registration and to speak with [redacted] objected to PO Monestime speaking with his sister and told her not to speak with the officers. PO Monestime told [redacted] to back up and placed a hand on [redacted] chest. [redacted] slapped PO Monestime's hand. PO Monestime attempted to grab [redacted] who backed away. The two fell onto the ground in the middle of the street. [redacted] braced himself above PO Monestime, who was lying on his back, underneath [redacted] PO Monestime struck [redacted] three times in the face as PO Hinderman attempted to grab [redacted] from behind (Allegation A: Physical Force, [redacted]). Once [redacted] learned they were recording, he allowed himself to be handcuffed. Several other officers from the 44th Precinct arrived at the location, including Police Officer Robert Gaylog. The group of officers escorted [redacted] to PO Monestime's police vehicle. [redacted] refused to enter the vehicle, causing PO Gaylog, PO Monestime, and PO Hinderman to push him into the vehicle.
