Summary

On December 22, 2019, at approximately 11:30 p.m., Police Officer Christopher Sanabria and Police Officer Daniel Leboff of the 113th Precinct stopped the car in which [redacted] and [redacted] were occupants at [redacted] in Queens (Allegations A-B: Abuse of Authority, [redacted]). PO Leboff approached the driver's side, while PO Sanabria approached the passenger side of the vehicle. PO Leboff began to speak with [redacted] and asked for his identification. Once [redacted] provided his identification, PO Leboff checked it in the NYPD system. After checking the identification, PO Leboff allegedly asked [redacted] about previous criminal charges that he might have faced in Virginia and [redacted]'s parole and instructed [redacted] to step out of the vehicle. PO Leboff patted [redacted] down, asking him questions about possible marijuana, and searched the insides of [redacted]'s jacket pockets (Allegations C-E: Abuse of Authority, [redacted]). The officers then ordered [redacted] out of the vehicle and instructed her and [redacted] to stand at the rear of the vehicle. PO Sanabria stood with [redacted] and [redacted] at the rear of the vehicle while PO Leboff searched the front and rear seats of the vehicle along with the trunk (Allegation F: Abuse of Authority, [redacted]). PO Leboff instructed [redacted] and [redacted] to get back into the vehicle and claimed that he had found marijuana during his search. He had also found a credit card skimmer and a fraudulent credit card during his search.
