Summary

On April 23, 2020 at approximately 7:30 p.m., [redacted] walked to McDonald's, located at 3275 Richmond Avenue in Greenridge Plaza in Staten Island, with his three unidentified children. [redacted] observed approximately 30 individuals on motorcycles in the plaza parking lot. PO Kristin Caldararo of the 122nd Precinct spoke with one of the individuals on a motorcycle. [redacted] approached PO Jadd Zarieh of the 122nd Precinct and asked if it was okay for so many people to be gathered together given the Emergency Order, and PO Caldararo responded, "Mind your fucking business." (Allegation A-Discourtesy, [redacted]) After the short interaction, [redacted] and his children went into the McDonald's. When they exited the McDonald's, [redacted] started to take a photograph of the officers and the motorcyclists. PO Caldararo turned around and grabbed [redacted] phone out of his hand (Allegations B and C-Abuse of Authority, [redacted]). PO Caldararo allegedly grabbed [redacted] right forearm for approximately a minute (Allegation D-Force, [redacted]). PO Caldararo stated that [redacted] was going to jail and asked him for his ID (Allegation E-Abuse of Authority, [redacted]). PO Zahrieh told PO Caldararo to return the phone to [redacted] and [redacted] began to walk away with his children.
