On April 9, 2020, at approximately 10:30 p.m., in the vicinity of [redacted] in the Bronx, [redacted] double parked his vehicle, exited, and approached the deli at that location. PO Andrew Alvarado and PO Adam Keegan of the 44th Precinct walked up behind him and instructed him to return to his vehicle. [redacted] allegedly told the officers that he was going to start recording on his cellphone, then PO Alvarado grabbed [redacted]'s phone and began to escort [redacted] back to the vehicle (Allegation A: Abuse of Authority, [redacted]). PO Alvarado and PO Keegan escorted [redacted] to the street and Sgt. Negersmith took over for PO Keegan. PO Alvarado and Sgt. Negersmith brought [redacted] to the back of his vehicle. [redacted] turned suddenly to face PO Alvarado, and PO Alvarado and Sgt. Negersmith brought [redacted] to the ground (Allegations B and C: Force, [redacted]). PO Keegan walked over and assisted with handcuffing [redacted].
An unidentified bystander observed the arrest and walked into the street. PO Alvarado told the individual to "Get on the fucking sidewalk,” (Allegation D: Discourtesy, [redacted]). Sgt. Negersmith instructed the individual to get off the sidewalk and then walked over and pushed him onto the sidewalk (Allegation E: Force, [redacted]). [redacted] was placed into the police vehicle and Sgt. Negersmith instructed PO Alvarado to transport [redacted]'s vehicle to the 44th Precinct stationhouse (Allegation F: Abuse of Authority, [redacted]).
At approximately 10:45 p.m., at the 44th Precinct stationhouse in the Bronx, PO Keegan, PO Alvarado, and Sgt. Negersmith brought [redacted] to the desk area. [redacted] fell to the ground on his own and PO Alvarado and PO Keegan helped him into a chair. PO Alvarado stated, “There you go, bro, a chair like you're in fucking kindergarten” (Allegation G: Discourtesy, [redacted]). [redacted] was then placed in the holding cell area.
