Summary

At approximately 3:00 p.m. on April 26, 2020, [redacted] was walking westbound on East 158th Street in the Bronx towards River Avenue while smoking a cigarette. After he crossed River Avenue to the west side and threw the cigarette down, two officers, Police Officer Ryan Brady and Police Officer Kieran Brennan of the 44th Precinct, approached him in a marked vehicle. [redacted] began to walk away. The officers exited the vehicle and stopped [redacted] Police Officer Brady and Police Officer Brennan placed [redacted] in handcuffs and then frisked [redacted] (Allegation A: Abuse of Authority - Frisk - [redacted] and Allegation B: Abuse of Authority – Frisk – [redacted]) and searched his pockets (Allegation C: Abuse of Authority – Search (of person) [redacted] and Allegation D: Abuse of Authority – Search (of person) - [redacted]). During their interaction, [redacted] asked Police Officer Brady for his shield number; Police Officer Brady allegedly did not provide this information verbally (Allegation E: Abuse of Authority – Refusal to provide shield number - [redacted]). After the officers began to issue a summons to [redacted] for the [redacted] Police Officer Brady threatened to give additional summonses to [redacted] (Allegation F: Abuse of Authority – Threat of summons - [redacted]). After the officers issued [redacted] his summons, they removed his handcuffs. Both Police Officer Brennan and Police Officer Brady allegedly pushed [redacted] away once his handcuffs were removed (Allegation G: Force – Physical force - [redacted] and Allegation H: Force – Physical force - [redacted]). As the officers were leaving, Police Officer Brady allegedly told [redacted] that he was being "childish" and "less of a man" (Allegation I: Discourtesy – Word – [redacted]).
