On April 22, 2020, shortly before 11:49 p.m., [redacted] exited the Pennsylvania Avenue "3" subway station in Brooklyn and began walking east along [redacted] toward his residence. Police Officers Kevin Morgan, Phillip Bilmes, and Marc Whirl, then assigned to the 75th Precinct's Anti-Crime team, drove up next to him. As [redacted] walked along [redacted], PO Whirl allegedly called [redacted] a "faggot" and a "batty boy" over the vehicle's PA system (Allegation A: Offensive Language, [redacted]; Allegation B: Discourtesy, [redacted]). PO Morgan and [redacted] began arguing with each other. PO Morgan called [redacted] a "pussy" and "the N-word" (Allegations C-D: Offensive Language, [redacted]). PO Morgan threatened to "smack" [redacted] (Allegation E: Abuse of Authority, [redacted]). PO Morgan asked [redacted] if he knew his own father (Allegation D).
