Summary

On May 2, 2020, at approximately 10:30 PM, Police Officer James Lindquist and his partner Police Officer Ariel Guzman of the 52nd Precinct pulled [redacted]s vehicle over on East Gun Hill Road near Wayne Avenue in the Bronx after observing him driving dangerously (Allegations A & B: Abuse of Authority – Vehicle Stop, [redacted]). Another civilian, [redacted] was in the passenger seat of [redacted]s vehicle. As the two officers approached his car, [redacted] got out, shouted at the officers, and did not listen to their commands to get back inside. When [redacted] ignored PO Lindquist's following command to move to the rear of the vehicle, the two officers tried to move him, resulting in a minor physical struggle (Allegations C & D: Force, [redacted]). As the officers held [redacted] in place, PO Lindquist briefly frisked him (Allegation E: Abuse of Authority- Frisk, [redacted]).
At the same time, a patrol unit with Police Officer Ariel Eusebio, Police Officer Steven Torres, Police Officer Paul White, and Lieutenant Hugh Mackenzie, also of the 52nd Precinct was coincidentally driving by. These officers immediately stopped and ran to assist PO Lindquist and PO Guzman. PO Eusebio ran to where PO Lindquist and PO Guzman were struggling with [redacted] also using some physical force to gain control and eventually handcuff him (Allegations F: Force, [redacted]).
