On August 13, 2020, at approximately 4:00 a.m., in the vicinity of 56th Street and 4th Avenue in Brooklyn, [redacted] parked his vehicle and went to a store to buy a pack of cigarettes. When he returned to his vehicle, [redacted] saw PO Pace, of the 72nd Precinct, searching his vehicle (Allegation A: Abuse of Authority – Vehicle search, [redacted]). [redacted] then asked PO Pace and PO Migdal, also of the 72nd Precinct, for their names and they did not respond (Allegation B: Abuse of Authority – Refusal to provide name, [redacted]). PO Roller, also of the 72nd Precinct, was also on scene and asked [redacted] for his ID in order to issue him a summons. PO Roller said to [redacted], "If you don't provide your ID, you will be taken down to the precinct in order to verify your identity" (Allegation C: Abuse of Authority – Threat of arrest, [redacted]). Additional officers from the 72nd Precinct responded to the scene, including PO Hernandezcarpio, PO Lagrutta, PO Mcintosh, and Sgt. Mui. [redacted] eventually provided his ID and PO Roller issued him two summonses, [redacted] and [redacted] for leaving his vehicle running while unattended and another for double parking.
