Summary

On January 1, 2021, at approximately 3:20 a.m., Mr. [redacted] parked their vehicle at the corner of Almeda Avenue and Beach 58th Street in Queens. His girlfriend, [redacted] was in the front passenger's seat. PO [redacted] and PO [redacted] of the 101st Precinct approached the vehicle. PO [redacted] asked Mr. [redacted] for his driver's license, registration, and insurance card. Mr. [redacted] asked for PO [redacted] name, and she allegedly did not provide it to him (Allegation A: Abuse of Authority, Unfounded). PO [redacted] instructed Mr. [redacted] to exit the vehicle and allegedly used profanity while asking him to step out (Allegation B: Discourtesy, Unfounded). PO [redacted] opened the driver's door of the vehicle and allegedly pulled Mr. [redacted] out by his shirt and pushed him against the vehicle (Allegations C and D: Force, Unfounded). PO [redacted] and PO Philip Jendzo, also of the 101st Precinct, began rear handcuffing Mr. [redacted] While handcuffed, Mr. [redacted] tried to hold onto his phone, the title deed, and the bill of sale of the vehicle.
