On June 8, 2021, at approximately 9:55 a.m., [redacted] entered the Flushing Avenue subway station in Brooklyn, through the emergency gate without paying. PO Mario Valencia and PO Manuel Garcia of Transit District 33, who stood inside the subway station, approached [redacted] and pushed him out through the open gate (Allegations A and B: Force: [redacted]). PO Valencia allegedly told [redacted] to "get the fuck" out (Allegation C: Discourtesy: [redacted]). PO Valencia said, "Don't fucking touch me" (within Allegation C). PO Valencia and PO Garcia allegedly pushed [redacted] against a window and allegedly damaged his cell phone as a result (Allegations D and E: Force: [redacted] Allegations F and G: Abuse of Authority: [redacted]).
