Description: On August 15, 2022, Plaintiff Jose Rivera was falsely arrested in the vicinity of the intersection of Van Sinderen Avenue and Fulton Street in Kings County. At approximately 11:25 a.m., while plaintiff was waiting for the A train, defendant NYPD officers, including Police Officer Manuel A. Garcia, searched Mr. Rivera without probable cause. Defendant police officers found a pocketknife in plaintiff’s pocket. Notwithstanding that the knife was a legal folding knife, defendants arrested Mr. Rivera and applied handcuffs to his wrists so tightly that it caused severe pain, discomfort and lacerations.
