On July 3, 2022, at approximately 4:20 a.m., an unknown individual [identified through BWC as [redacted] was brought into the 7th Precinct stationhouse and presented in front of Sergeant Maris Garcia, who was the desk officer. [redacted] was cursing at Sgt. Garcia, stating "Suck my dick" along with other expletives. Sgt. Maris responded, "You don't have one" and "watch your fucking mouth". (Allegation A: Offensive Language, [redacted] (Allegation B: Discourtesy, [redacted] was arrested and brought into the 7th Precinct stationhouse after this male. Police Officer Michael Sisinni stood with [redacted] and allegedly pulled [redacted] hair (Allegation C: Force, [redacted]). Sgt. Garcia told [redacted] that she would be going to the hospital because she was acting "crazy" (Allegation D: Abuse of Authority, [redacted] Allegation E: Offensive Language, [redacted] and within Allegation H). [redacted] told Sgt. Garcia to suck her "dick." In response, Sgt. Garcia asked [redacted] if she had a "dick" several times (Allegation F: Offensive Language, [redacted] and within Allegation H). Finally, [redacted] referred to Sgt. Garcia as "Nigga" several times. Sgt. Garcia responded by stating, "I am not your nigger. I am not your nigger" (Allegation G: Offensive Language, [redacted] Allegation H: Discourtesy, [redacted]).
[redacted] was arrested during this incident for driving while intoxicated, leaving the scene an incident without reporting property damage, and refusing to take a breath test. [redacted] was arrested during this incident for robbery in the second degree, criminal mischief in the second degree, assaulting a police officer/fireman/EMT, resisting arrest, obstructing governmental administration in the second degree, and disorderly conduct.
