On March 21, 2023, at 12:51 a.m., inside the 103rd Street-Corona Plaza station in Queens, PO John Ogunmoyin and PO Steven Balu, both of TD 20, approached [redacted] and [redacted] for allegedly evading paying the fare. PO Ogunmoyin had a physical interaction with [redacted] near the turnstile (Allegation A: Force, unable to determine). PO Ogunmoyin then pushed both [redacted] and [redacted] (Allegations B, C: Force, substantiated).
PO Ogunmoyin made numerous discourteous statements to both [redacted] and [redacted] including, "Get on the fucking train," "Keep fucking with me," "Eat shit," "I don't give a fuck," and, "We're not paying you shit" (Allegations D, E: Discourtesy, substantiated). PO Ogunmoyin threatened [redacted] with the use of force (Allegation F: Abuse of Authority, substantiated).
PO Ogunmoyin engaged in a physical altercation with both individuals in which he punched [redacted] in the face and chest area fourteen times, kneed him in the stomach area, and threw him to the ground (Allegation G: Force, substantiated). PO Ogunmoyin punched [redacted] in the face four times and also threw him to the ground (Allegation H: Force, substantiated). PO Badlu failed to intervene in PO Ogunmoyin's use of excessive force (Allegations I, J: Force, miscellaneous – subject resigned).
Additional officers responded to the scene, including PO Rodger Pineda, PO Jose Taveras, and PO Tristian Etienne, all of TD 20. At one point, PO Ogunmoyin said to [redacted] "Get the fuck off me" (Allegation K: Discourtesy, within NYPD guidelines). PO Pineda said, "Fuck that," as well as, "Give me your fuck – give me your fucking - don't fucking resist," to [redacted] (Allegation L: Discourtesy, substantiated).
