Description: On November 19, 2019, plaintiff Frank Brandon was involved in an automobile accident. NYPD officer Tuhin Khan and his partner arrived on the scene. The other driver accused plaintiff of being intoxicated, which plaintiff denied. Khan requested plaintiff take a Breathalyzer test at the precinct, which showed there was no alcohol in plaintiff's system. A third officer stated he believed plaintiff was under the influence of drugs, which plaintiff denied, completing a series of coordination tests without issue. A highway patrol officer then claimed that a black light revealed the presence of a white powder substance on plaintiff's face.
