Description: Plaintiff was the passenger in a vehicle that was hit by another car making an illegal U-turn. Defendant officer Foley appeared on the scene, heard the passengers and witnesses accounts, and then approached Plaintiff and frisked him. Plaintiff and the driver refused to have the officer search the car, so he was handcuffed, taken to the 44th Precinct. For this incident, Plaintiff was charged with Criminal Possession of a Weapon in the Third Degree, Reckless Endangerment in the Second, Criminal Possession of a Controlled Substance in the Seventh, Possession of Stolen Property in the Fifth, and Aggravated Unlicensed Operation of a Motor vehicle in the Third.
