Description: On January 27, 2017, the plaintiff, who is an African American male, was in the vicinity of an NYCHA building to pick up his child from his babysitter. While on the phone with his wife to confirm the babysitter's apartment number, defendant officers Michael Rodriguez and John/Jane Doe 1-10 stopped and unlawfully searched the plaintiff then placed him under arrest for trespassing in the NYCHA building, despite the fact that the plaintiff explained his reason for being there and further explained that he actually resided in the NYCHA building adjacent to the one his babysitter was living in and where he was picking his child up from.
