Complaint
Description: On January 14, 2014 at 8 p.m. (approx.), Plaintiff had placed and was waiting for a takeout order at Land of Plenty, a Chinese restaurant. While waiting, officers entered the restaurant and questioned the owner about a disturbance. Knowing that the owner spoke little English, Plaintiff attempted to assist and told the officers that he saw no disturbance in the 20 or so minutes he had been at the location. The officers told him to not get involved. Plaintiff replied that he was merely trying to help as a witness. Officer Phillip Gustavino then pushed Plaintiff and told him to leave the restaurant. Plaintiff refused as he was still waiting for his order and went to sit down. Officer Gustavino responded by grabbin...
