Plaintiff was then handcuffed, leaving her front exposed and naked, and humiliated by derogatory comments made by officers. Description: On September 17, 2010, Plaintiff Tyrone Gearles was lawfully present in the vicinity at Marcus Garvey Park speaking with some friends when Defendant Officers approached and frisked them without any probable cause or reasonable suspicion. Defendant Officers found nothing, but told Plaintiff he was under arrest for selling marijuana. Description: On the incident date, the plaintiff was arrested for sale of a controlled substance when the defendants jumped out of an unmarked car and handcuffed the plaintiff. His pockets were searched and the contents were placed in a yellow envelope by the defendants. The plaintiff was brought to the 25th precinct where he was placed in the holding cell area and told to get naked. The plaintiff did not comply and was jumped, beaten, had his clothes torn off, and underwent a "visually" and "manually cavity" search by the defendants.
