The Officers exited from an unmarked vehicle and approached the Plaintiff before grabbing his arms and placing him under arrest for driving under the influence. They had no basis for this arrest and did not allow the Plaintiff to submit to any sobriety testing. The charges were false thus initiating malicious prosecution.
