Description: On February 9, 2013, Plaintiff was inside her Manhattan apartment when Defendant Officers knocked on her door and entered. Defendant Officer Rodriguez told the Plaintiff that a neighbor reported that she had a weapon. Plaintiff told the Defendants that he does not have a weapon and that this same neighbor had been harassing her for some time, that Plaintiff had an order of protection against this neighbor, and that this neighbor filed false reports against her before. Other Defendant Officers then entered and placed Plaintiff under arrest, denying her the opportunity to put on warmer clothes as it was cold and snowing outside.
