Description: On September 14, 2013 Defendant officers Nelson, Hernandez, and two others in plain clothes entered a 7-Eleven in Brooklyn. The defendant officers were responding to a call made by a store employee after an argument took place with the Plaintiff. The argument occurred after the store employee made inappropriate and racially disparaging remarks about the Plaintiff's wife. Without saying a word to the Plaintiff, Defendant officer Nelson and the officers in plain clothes took plaintiff in custody. Plaintiff's wife, who had been waiting in the car outside, entered the store and inquired about the situation after seeing her husband in handcuffs.
