Description: On September 14, 2013 Defendant officers Nelson, Hernandez, and two others in plain clothes entered a 7-Eleven in Brooklyn. The defendant officers were responding to a call made by a store employee after an argument took place with the Plaintiff. The argument occurred after the store employee made inappropriate and racially disparaging remarks about the Plaintiff's wife. Without saying a word to the Plaintiff, Defendant officer Nelson and the officers in plain clothes took plaintiff in custody.
