On December 4, 2015, at approximately 8:00 p.m., [redacted] went to [redacted] in Brooklyn, the residence of [redacted] and began calling his wife, [redacted] on his phone. [redacted] and [redacted] are separated, and [redacted] was staying with [redacted] her current boyfriend. [redacted] and [redacted] had orders of protection against each other, but [redacted] nevertheless wanted to speak with [redacted].
After calling [redacted] several times, [redacted] walked to the end of the block (the intersection of Bay Parkway and 78th Street), where he was approached by [redacted] punched [redacted] in his head, causing him to fall down. [redacted] sustained swelling to his buttocks and hand as a result, and also felt dizzy. [redacted] and [redacted] all called the police, and PO Christian Rustand and PO Frank Tornabene, both of the 62nd Precinct, arrived shortly afterwards in a marked vehicle. Almost immediately after these first officers arrived, PO Florin Coste and PO John Sellitti pulled up in a second vehicle, with [redacted] in the backseat.
PO Rustand and PO Tornabene placed [redacted] in handcuffs while PO Coste and PO Sellitti took statements from [redacted] and [redacted]. [redacted] told PO Rustand and PO Tornabene that [redacted] had assaulted him, but PO Tornabene ignored this. [redacted] told PO Tornabene that his head and hand were in pain, and that he wanted to go to a hospital. [redacted]'s first language is Cantonese, but he knows English well enough to have conveyed his medical request. He did not provide any further description of his pain or injury, however. PO Tornabene did not say anything in response to [redacted] (Allegation A). [redacted] told PO Tornabene he needed medical treatment again, and again the officer did not respond. The officers then placed [redacted] in their vehicle and transported him to the 62nd Precinct stationhouse, where he was placed under arrest for [redacted].
