Description: On November 17, 2020, an employee was stabbed in a restaurant (Ms. Jannetty Ramos), and the incident and the prior verbal altercation were recorded on cameras throughout the building. Upon police arrival at the scene, Defendant PO Murphy viewed a still shot of the incident and stated his belief that the assailant was Plaintiff Malik Mitchell. Defendant Murphy stated that he recognized Plaintiff Mitchell after arresting him previously. Based on PO Murphy's presumption, Defendant Detective Patterson investigated Plaintiff Mitchell and prepared a photo array for Ms. Ramos to view.
