Description: On November 29, 2018, Plaintiff Dwayne Hackshaw was at home (120 Baruch Drive, NY, NY) when Defendant Officers Kyle G. Barnett and John Does 1-8 unlawfully entered his residence and arrested him for possession of a firearm. Defendant officers claimed they had allegedly found a firearm at his daughter's grandmother's house that belonged to him, but his DNA was not found on it and he had no knowledge about it. He was not a resident at that location and the police did not allege that he lived there, nor did they recover a firearm on his person or inside his home. After being held for 21 hours, and missing 2 days of work, Plaintiff was released from Central Booking when he was declined to prosecute.
