On March 4, 2020, at approximately 2:51 a.m., at [redacted] in Brooklyn, [redacted] was stopped by three police officers—Lieutenant Henry Daverin from the 90th Precinct at the time of this incident, Police Officer Kyle Barnett, and Police Officer Patrick Foley-both from the Intel Criminal Section at the time of this incident, while attempting to get into his vehicle (Allegations A and B: Abuse of Authority-Stop, [redacted] (Allegation C: Abuse of Authority-Stop, [redacted]). Lieutenant Daverin and PO Barnett allegedly pushed [redacted] into a fence. The officers held [redacted] s upper body in place with one of their hands and held up fists using their free hands (Allegations D and E: Force-Physical Force, [redacted]). PO Barnett allegedly told [redacted] to "stop fucking moving", among multiple other discourteous and offensive statements, including "we're going to take this nigga the fuck down" (Allegation F: Discourtesy-Word, [redacted] (Allegation G: Offensive Language-Race, [redacted]). Lieutenant Daverin allegedly joined PO Barnett in making discourteous remarks, telling [redacted] that the vehicle was not his "fucking car" (Allegation H: Discourtesy-Word, [redacted]).
