After the cousin refused to comply with the request, Ching proceeded to follow plaintiff and forcibly entered plaintiff's family apartment. Ching violently pushed plaintiff and conducted an illegal search. P.O. Tatiana Cruz then handcuffed plaintiff in an excessively tight manner and transported him to a precinct.
