Description: On September 29, 2011, Plaintiff was loading a rented truck as part of a move when NYPD officers approached. Defendant Office James Barry and others prevented Plaintiff from continuing his task and questioned him about selling marijuana. The officers then illegally searched Plaintiff and his possessions, but found nothing. Despite being lawfully engaged in moving, Defendant Barry and other officers arrested Plaintiff on drug charges and prepared false documents supporting that claim. Plaintiff spent 15 hours in custody before being released, and all charges were dismissed on December 11, 2012.
