Description: On March 28, 2016 at 9:15 PM, Plaintiff Arthur Berkovitz was driving his vehicle down Harlem River Drive. As he was driving, a non-police car approached at a high speed, that was driven by Defendant Sample. The car was tailgating Plaintiff and driving at an excessive speed, and Sample lowered his window, screamed, and threw items at plaintiff's car, causing Plaintiff to fear for his safety and call 911. Sample never revealed he was a police officer. Mr Berkovitz left the freeway, and Sample followed. Description: On March 1, 2016, police officers arrived at plaintiff's apartment to conduct a wellness check at the request of his sister. They broke down the plaintiff's door when he did not agree to let him in. Officers Carlucci, Phillips, Scourtos and other unknown officers beat the plaintiff while mocking and humiliating him. They also mimicked "gay sexual acts" on the plaintiff. They then drugged the plaintiff and took him to the Bellevue "hospital facility for mentally ill people." Plaintiff was detained at the hospital and did not receive treatment for his injuries.
