Description: Plaintiff was walking to the store when he saw a crowd of individuals and someone starting a fight. Plaintiff tried to talk to the individual when Defendant Officers approached him and grabbed him. Officer Ortiz hit Plaintiff, arrested him, and began transporting him to the 44th Precinct. Plaintiff Payano pepper sprayed Plaintiff in the back of the car. Plaintiff was brought to the precinct and the hospital, then charged with 205.30, 240.10, 240.20, and 240.26, which he was found Not Guilty of 3 years later.

Description: Plaintiff was inside a parking lot with his friend when the defendants, P.O. Guzman and Ortiz pulled up in their unmarked car and began to question the plaintiff and his friend. Plaintiff and his friend were stopped, frisked, arrested for trespassing, and the defendants allegedly found marijuana on the plaintiff's person. Plaintiff was taken to the 33rd precinct with tight handcuffs where he was strip searched and charged with trespassing and marijuana. Plaintiff was released on ROR by the judge and had his charges thrown out a year later.
