Description: On February 28, 2013, at approximately 2:00 p.m., plaintiff was lawfully present in the vicinity of 47th Street and Broadway, New York, New York, and was lawfully distributing compact discs containing his own original music, which are protected items under the First Amendment. While plaintiff was lawfully distributing his compact discs, the defendant police officers unlawfully approached, stopped, seized, searched, and arrested plaintiff, without reasonable suspicion, probable cause, or any legal justification. The defendant police officers (Police Officer Immer Mata, Shield No. 11543, and Police Officer John Does # 1-4) forcibly transported plaintiff, against his will, to the 18 precinct stationhouse.
