Complaint
Description: On December 8, 2013, the Plaintiff was a bicycle rider involved in a motor vehicle accident in which she was thrown from her bicycle and seriously injured. Defendant officer Garcia responded to the scene of the accident and began speaking with witnesses. The Defendant did not record or memorialize any identifying information about the motor vehicle involved in the accident, the driver of the vehicle, or any information about any of the witnesses to the accident. Plaintiff, who was severely injured as result of the accident, was relying on the Defendant for assistance at the scene and expected him to obtain, record, and memorialize information about the driver of the car that caused the accident.
