Description: On or about November 4, 2017, the plaintiff, a for-hire-vehicle driver, residing in New Jersey drove into Brooklyn in order to return a former passenger's phone that had been mistakenly left in the plaintiff's for-hire vehicle. Prior to arriving, the plaintiff and his former passenger had engaged in a series of text messages. The plaintiff had offered to mail the former passenger their phone at no-charge. However, the former passenger requested that the plaintiff drive from New Jersey to Brooklyn and hand deliver the phone. Description: The plaintiff was walking home pushing his son in a stroller when the defendant officers approached him and told him he was walking in the wrong direction home. The plaintiff said he knew where he was going and then the officers got out of their vehicle and pushed the stroller over and hit the plaintiff repeatedly, handcuffed him, and took him to the 83rd Precinct. The plaintiff was charged with inter alia Endangering the Welfare of a Child and Resisting Arrest. The prosecutors did not return a true bill.
