Description: On March 1, 2013, Plaintiff, an Hispanic male, was lawfully present on the sidewalk at E. 139th St. and St. Ann's Ave, Bronx, NY when Defendant officers whistled at Plaintiff to get Plaintiff's attention. Defendant officers summoned Plaintiff to their patrol car. Plaintiff approached the vehicle and presented proper ID. Officers stepped out of the car and demanded Plaintiff sit on the ground. Plaintiff refused, stating he had done nothing wrong. Plaintiff was told to not speak and physically forced to the ground using extreme force.
