Description: Defendant Officer approached plaintiff and proceeded to attack, assault, batter, and place Plaintiff in a chokehold, while Plaintiff repeatedly asked for help and whether he did something wrong. Defendant Officer pushed Plaintiff to the ground, applied a chokehold to Plaintiff's throat, and arrested Plaintiff. Even though Plaintiff did not resist arrest, struggle, or fight the Defendant Officers, Defendant Officer gill pepper sprayed Plaintiff. Plaintiff was detained at Central Booking and was released after 16 hours in custody. Upon release, Plaintiff was falsely charged with resisting arrest, failing to comply with park signage, and destroying or abusing park property/equipment.
