Description: On August 9, 2013, Plaintiff Anthony Anderson, a 45-year-old black male, was unlawfully stopped, arrested and imprisoned by NYPD after lawfully sitting outside a family member's residential building. As the plaintiff prepared to leave the premises, defendant officers Arjona and Charles walked by on their patrol and questioned plaintiff about a nearby closed bottle of liquor. Defendant Arjona advised the plaintiff that he was going to issue him a summons for an open container, however, the plaintiff stated that he had not been drinking, and provided defendant Arjona identification upon request.
