Description: On April 1, 2019, PO Edouard Fitz, without just cause or provocation, approached and violently handcuffed Plaintiff. PO Fitz intentionally and falsely accused Plaintiff of Criminal Possession of a Weapon in the 2nd Degree and took Plaintiff to a police precinct in Bronx County. Plaintiff was forced to remain in a precinct cell until Plaintiff was transported to Bronx Central Booking before being released from Central Booking on April 2, 2019 without appearing before a Judge or being prosecuted for any crime or offense. Complaint
Description: On October 12, 2016 at approximately 9:00 p.m., Plaintiff Ibrahim Berete was unlawfully stopped, searched, assaulted with excessive force and detained by the defendants, the City of New York, the New York City Police Department, NYPD Officer Edouard Fitz, and unnamed NYPD officers John Doe and John Roe. The plaintiff was lawfully in the vicinity of 163rd Street and Brook Avenue in the Bronx when the defendants approached him. The defendants did not have a warrant, reasonable cause, or probable cause of criminal activity to stop and search the plaintiff. Rather, the defendants stopped and questioned the plaintiff based solely on his age and/or race. Subsequently, the defendants transported the plaintiff to a pol...
