Description: On December 9, 2022, at Lenox Ave and W. 134th St, NY, NY, Plaintiff was lawfully sitting inside his motor vehicle, when Defendants approached, pulled out of his vehicle, and arrested Plaintiff. Defendants grabbed Plaintiff about his body before contorting his arms behind his back and applied tight metal handcuffs. Defendants grabbed and seized Plaintiff’s person with their outstretched hands before rifling their hands through Plaintiff’s belongings. Plaintiff requested the handcuffs be loosened, but Defendants ignored Plaintiff’s pleas. Plaintiff was removed to the 32nd Precinct. Description: On June 3, 2023, and officer Jose Tavarez and unnamed officers approached, grabbed, assaulted Plaintiff and threw Plaintiff on the ground. Plaintiff was then taken to the 32nd precinct, where he was placed in a cell, handcuffed and fingerprinted. Then, Plaintiff was taken to Central Booking, whereby he saw a judge and was released on his own recognizance. Plaintiff was falsely charged with various crimes and caused to appear in Criminal Court. On June 23, 2023, all charges against Plaintiff were dismissed.
