Description: On or about February 2, 2023, Plaintiff Justin De La Cruz was involved in an incident at 305 80th Street, Brooklyn, NY, following a 911 call about a landlord-tenant dispute. The responding NYPD officers, including Daniel Wynne, Justin Garcia, Pedro Lopez, and Aaliyah Card, escalated the situation, even though no criminal matter was involved. Officer Wynne falsely broadcasted that Plaintiff was armed and involved in a murder, leading to the officers using excessive force. Description: On July 12, 2020 at a Blue Lives Matter march, where counter-protestors, including Plaintiff were present, members of the NYPD, including the defendants, blocked paths of egress, surround counter-protestors, and force them close together on the sidewalk. Defendant NYPD Sergeant Yuriy Akopov approached Plaintiff and ordered her to move from where she was standing on the sidewalk, but Plaintiff was unable to do so, as members of the NYPD had surrounded and kettled the counter-protestors. Description: On or about November 2, 2014, defendant NYPD officers Daniel Zhang, Pedro Lopez and Joseph Kaiser, along with unnamed defendant NYPD sergeant Annemarie Murphy, as well as unnamed defendant NYPD officers, repeatedly shot (with handguns), assaulted and battered plaintiff, while subjecting him to an illegal search, and falsely arresting him. Defendants then maliciously prosecuted plaintiff by making false allegations against him to support false criminal charges. Plaintiff suffered severe/life threatening physical and mental injuries as a result of this incident. The complaint does not specify which specific defendant shot the plaintiff, just lumps the defendants in together.
