Description: On November 4, 2012, Plaintiff was eating at a business when, without any just cause, Plaintiff was forced to leave the premises by an employee of the business. Prior to being asked to leave, Defendant NYPD officers Appel and Siracusa, as well as several other unknown Defendant NYPD officers, were rudely speaking to Plaintiff and his friends and threatening them. After being thrown out of the business, Plaintiff attempted to call a cab. While waiting for his cab, Plaintiff was grabbed and thrown against a police car by Defendant Appel. Plaintiff was then arrested by the Defendant officers and placed in a jail cell. All charges against Plaintiff were eventually dismissed.

Description: On October 23, 2010, Plaintiff and a co-worker were en route to the subway station at Chauncey Street and Broadway in Brooklyn. The Plaintiff proceeded up the stairs to purchase a metro-card. He was approached by Rinvil, Estevez and Appel. Rinvil asked Plaintiff for ID. Plaintiff complied. Defendants accused plaintiff of smoking a cigarette. Rinvil ordered Plaintiff to turn around and place his hands behind his back. Plaintiff began to comply when Estevez sprayed mace into the Plaintiff's face. Plaintiff was thrown on the ground, then down a flight of stairs. Plaintiff flagged down a marked police vehicle.
