Description: On August 14, 2016, at 11:45pm, burglars broke into the home of Plaintiff's neighbor. Canvassing the scene, Defendants Det. Colin Sparks & Det. Michael Cerullo spoke with Plaintiff, who informed them that he had worked from 9pm-4:30am that night and therefore had no personal knowledge of the burglary. On October 27, 2016, Defendants Sparks & Cerullo returned to Plaintiff's residence while he was at work, leaving a message with his mother to have him report to the 105th Precinct. When Plaintiff complied, he was searched, seized, & arrested by Defendants Sparks & Cerullo (approved by Defendant Lt. Stephen Faber). Plaintiff was detained for 22 days, until November 17, 2016.

Plaintiff was pulled out of the car, Officer Sparks put a gun to his head and threatened to shoot him, and then assaulted him. Plaintiff was taken to the 107th Precinct and charged with criminal possession of a weapon, attempted robbery in the first degree, and resisting arrest, which he was acquitted of after a jury trial.
