Description: On May 30, 2012, Plaintiff was on the sidewalk on Broadway, between Marion Street and Stone Avenue in Brooklyn, New York. Defendants Martin and Walsh stopped Plaintiff and asked what was in his pocket. The Defendants then proceeded to search the Plaintiff and removed everything from his pockets. One of the Defendants found half of an Oxycodone pill and Plaintiff informed them that it was a medication for which he had a prescription. Nevertheless, Defendants arrested him on a charge of Criminal Possession of a Controlled Substance in the Seventh Degree.
