Description: On December 9, 2012, Jamel Zellner ("Plaintiff") was arrested for aggressive begging and disorderly conduct. Officers in plain clothes approached him, grabbed his right arm, twisted it and said, "Don't Move". He was then immediately handcuffed. Plaintiff was merely selling his music from behind a table out of the way of civilian traffic when police officers, including Police Officer Jonathan Acquaviva ("Defendant")arrested him for aggressive panhandling. Description: On August 11, 2012, Plaintiff was lawfully distributing CDs of his own original music at approximately 6:50 p.m. on 7th Avenue when several Officers, including Defendant Officer Tansey, approached Plaintiff. Defendant Tansey and the other officers unlawfully searched Plaintiff without any probable cause. Defendant Officers then unlawfully placed Plaintiff under arrest and falsely informed the District Attorney's office that Plaintiff committed the following crimes: Aggressive Begging in a Public Place, and Disorderly Conduct.
