Description: On April 11, 2012, in the vicinity of Seventh Avenue and West 46th Street in Manhattan, New York, NYPD Officer Jonathan Acquaviva and several unknown officers approached Plaintiff as he lawfully distributed CDs containing his own original music. Despite having no probable cause of criminal activity, the officers unlawfully searched and arrested Plaintiff. Mr. Acquaviva and the officers then falsely informed the New York County District Attorney's Office that they had observed Plaintiff engaging in violations of the New York Penal Code and the New York Administrative Code. Ultimately Plaintiff was released from custody, and the criminal charges associated with his arrest were adjourned in contemplation of dismi...
