Description: Plaintiff-Decedent was a mentally disabled female senior citizen of color. On October 18, 2016, she was shot and killed after the NYPD responded to a noise complaint from her neighbor. Plaintiff-Decedent was suffering from an episode related to her disability, and historically, unarmed specially trained ESU officers were sent to respond. On October 18, 2016, a 911 communications dispatcher incorrectly dispatched NYPD officers and falsely labeled Plaintiff-Decedent as violent, despite her not having any weapons. Description: On June 28, 2011, plaintiffs attended a hip-hop concert at a night club in Manhattan's Lower East Side. A few minutes after midnight, June 29, 2011, numerous members of the NYPD responded to the nightclub and ordered everyone to exit the nightclub. Plaintiff Pena complied with with orders to leave and walked towards the exit. Officers McDougall and Chau grabbed Pena from behind, and punched and kicked, and struck Pena with a baton all over his body. Pena was then thrown to the ground and sprayed in the eyes with mace.
