Description: On December 3, 2020, while lawfully present as a guest at 220W 133rd Street, the plaintiff was unlawfully stopped, questioned, battered, assaulted, and excessively arrested without legal justification by defendant officers. The defendants entered the premises seeking a target other than the plaintiff. Despite not being the target of the search warrant and not guilty of the alleged offenses, the plaintiff was taken into custody on false allegations of controlled substance possession and brought to an NYPD precinct. There, the plaintiff was subjected to a humiliating, warrantless, and unlawful manual cavity search, which yielded no illegal items. Complaint
Description: On November 27, 2019, Plaintiff Mellisa Ballance with lawfully in an apartment when Defendants Detective Ariel Eusebio, Detective Rashied McIntyre, Officer Yeraldy Bonifacio, Sergeant Frederic Ortiz, Officer Anthony Cassase, Captain Raul Maisonet, Officer John Katehis, Detective Rafael Mooscoso, Detective James Burpoe, Detective Gary Perez, Officer Justin McKnight, and Officer Carlos Ramos entered the apartment with tactical SWAT-style police equipment and shields. Plaintiff was stuck and cut with a ballistic shield, pushed onto furniture and the floor, and left in excessively tight handcuffs for an excessive period of time. As a result, Plaintiff sustained serious injury.
