Description: On February 22, 2019, plaintiff was working at a deli grocery at 3214 Third Avenue, Bronx, when an argument and fight broke out between a drunk customer and a cashier. Plaintiff attempted to stop the fight but did not strike or touch the customer. After police arrived at the scene, defendant police officers demanded security footage from plaintiff. Plaintiff claimed that only the store owner has access to the footage, but the owner was not present at the time. The officers threatened to arrest plaintiff if he did not produce the tape in that instant, and the intoxicated customer also falsely identified plaintiff as the person whom he had a fight with.
