Description: On July 1, 2022, plaintiff Mildred Santana observed Miguel Cruz removing a boot from her car and approached him to tell him not to. Defendants police officers Juan Marte and John Doe stopped, handcuffed and arrested Miguel Cruz and Plaintiff. Plaintiff was not engaged in any unlawful or illegal activity. Plaintiff was not assisting Miguel Cruz in any way in the removal or attempted removal of the boot from her car. Subsequently, Plaintiff was arrested and transported to the 49th precinct. After spending several hours at the 49th precinct, Plaintiff was removed to Bronx County Central Booking.
