Description: On August 29, 2013 Plaintiff was a lawfully licensed and credentialed ice cream street vendor who had suffered multiple acts of racially-motivated harassment by POs since 2011. On August 29, 2013, POs John Repetti and John Doe, who had previously falsely accused her of assault, approached her as she was lawfully selling ice cream and arrested her without probable cause, affixing excessively tight cuffs to Plaintiff's wrists. Plaintiff and her granddaughter asked why Plaintiff was being arrested and were both told to "shut up." POs threw out Plaintiff's entire supply of ice cream and put the cart in a police van.
