Description: On or about June 4, 2019, near Plaintiff’s residence, POs Hom and Opokuduro approached Plaintiff and took his elbow, and began to frisk him. POs, including Hom, Opokuduro, Melhado, Dambrosio, tackled and arrested Plaintiff without any legal basis, causing Plaintiff to hit the ground and be tightly handcuffed. POs explained the reason for the arrest was that he bore a physical resemblance to a shooting suspect, whose appearance was significantly different and who had already been arrested more than an hour before Hom and Opokuduro approached Plaintiff. Description: On August 5, 2017, on Lexington Avenue near the intersection of East 104th Street in Manhattan, Defendant Officer Cox was operating a police vehicle with other Defendant Officers. Defendant Officer Cox drove the automobile and passed plaintiff’s scooter. As the automobile was in front of plaintiff’s scooter, Defendant Office Cox stopped the automobile and opened the door of the automobile in such a manner that it struck Plaintiff’s scooter, knocking him from the scooter and causing Plaintiff to sustain serious injuries. In order to cover up their misconduct, Defendants Office Cox and other Defendant Officers prepared false reports that plaintiff drove the scooter into the police automobile.
